The Apple Wood Terms and Conditions

White Carpet croppedIn these terms and conditions the following terms have the following meanings:
Accommodation means the cabin shown in the confirmation invoice or as may otherwise be agreed in writing between Apple Wood House and the Visitor;

Agreement means the agreement between The Apple Wood and the Visitor for the holiday rental of Accommodation on these Terms and Conditions;

The Apple Wood means the company The Apple Wood whose office is at Apple Wood House, East Hill Road, Heytesbury, Warminster, Wiltshire, BA12 0HD

Visitor means the person named in the confirmation invoice, and whom will be deemed responsible for all persons accompanying him/her.

Please read these conditions of hire carefully. When making an on-line booking, once you have ticked the box on the on-line booking form, you are bound by this agreement.

1) Agreement

a) These Terms and Conditions are on our website and are emailed with the confirmation invoice. The making of a booking will form an agreement on these Terms and Conditions between the Visitor and The Apple Wood for the holiday rental of the Accommodation.

b) The Apple Wood permits the Visitor to occupy the Accommodation for the holiday period shown in the confirmation invoice together with the reasonable use of its contents.

2) Price Changes
Holiday prices may be reviewed periodically. Once a booking has been made, the price for that particular booking is agreed and will be honoured by both The Apple House and the Visitor unless the booking dates are subsequently extended by the visitor after a price review. If this occurs, the extended dates will attract the new per day charges and the original dates will remain at the originally agreed charges.

3) Booking and Payment Terms
a) Full payment of the booking fee is due on confirmation of booking
b) Your booking will be confirmed via email shortly after confirmed receipt of this on-line payment. Although we would not anticipate any costing errors, should there be an obviously incorrect price advised by us, then we will email a new invoice to you once the error is discovered by us and we will not be bound by the previously incorrect price advised.
c) We do not currently include Value Added Tax (“VAT”). However, should we reach the point of requiring to charge VAT The Apple Wood may amend prices accordingly. This will not affect the overall cost of bookings already made.
d) All payments must be made in Pounds Sterling (GBP).
e) Credit card charge applies for payments made using Visa, MasterCard or American Express of 1.5% on the total booking value. No charge applies for payments made by debit card.
f) A security and breakages deposit of £250 is payable before arrival. This will be refunded in full within 10 working days of the end of the holiday if there is no damage.

4) Cancellation
a) If a visitor wishes to cancel a booking it must give The Apple Wood notice in writing as soon as possible. Cancellation takes effect on the day we receive your written notification. The closer your cancellation is to your holiday start date, the less likely we are to recover the holiday costs by re-selling your Accommodation. Our cancellation charges therefore increase as the arrival date approaches.

b) Please note that we are not liable for any consequential loss or incidental expenditure resulting from the cancellation of your holiday and advise you to take out adequate travel insurance to cover your costs if you have to cancel your holiday for any reason.
c) It is extremely unlikely that we will have to make any changes to your property rental. However, occasionally we may have to make changes and reserve the right to do so at any time. Most of these changes would be minor and we will advise you of them as soon as they may be applicable.
d) If we are forced to cancel the property rental because of force majeure or for any reason that makes the property unfit for rental, you will receive a full refund of all monies paid to us.

5) The Apple Wood Right to Refuse/Alter
a) The Apple Wood may, at its discretion, refuse any booking.
b) The Apple Wood may cancel or alter arrangements made for the Visitor whether before or during the holiday period provided that such cancellation or alteration is necessary:
1. due to circumstances beyond the reasonable control of The Apple Wood; or
2. to perform or complete essential remedial or refurbishment works.
c) If a booking is altered or cancelled by The Apple Wood, it will take reasonable steps to offer a suitable alternative booking. If The Apple Wood is not able to offer such an alternative or the Visitor does not accept the alternative offered, The Apple Wood will return to the Visitor the relevant proportion of the holiday price paid by the Visitor to The Apple Wood in respect of the Accommodation and will not otherwise be liable for any additional loss caused by such alteration or cancellation.

6) Change of Booking
a) Transferred booking dates are permitted in excess of 60 days from the booked arrival date. If dates are requested to be changed by the visitor within 15 to 60 days, then a charge of £20 will be incurred. If the change is less than 14 days of booked arrival a charge of £100 will be incurred. These fees may be waived if the booking is moved to an earlier available date.
b) Transferred bookings will not normally be accepted from one calendar year to another of the Visitor’s holiday.

7) Occupancy & Maximum Numbers of Visitors
a) Occupation is limited to 6 people in the beds provided by The Apple Wood – no additional camp beds, tents, caravans, campervans or accommodation facilities of any description are permitted. The occupation limits are set in line with the maximum level of services available in the cabin. To exceed the maximum number of persons in a cabin (or its surrounds) overloads the facilities available which are often not designed for or capable of supporting additional usage, and can lead to extensive and expensive damage. Occupation must be wholly in line with the number of persons stated in the booking/contract and any variation of same must be agreed in writing, in advance of holiday commencement, by The Apple Wood.
b) As such any over-occupancy is considered to be a serious infringement of the Terms and Conditions and may result in an immediate requirement to vacate the premises, without any refund, and possible further charges for the visitor in the event of damage to the facilities. For example, a malfunctioning septic tank which has been used by a greater number of people than the tank is designed for and for as long as these damages impact upon the rental of the property to subsequent visitors.
c) The Agreement is personal to the Visitor. The Visitor must not use the Accommodation except for the purpose of a holiday by the Visitor and the Visitor’s party during the holiday period, and not for any other purpose or longer period.
d) The maximum occupancy of the Accommodation shall not be exceeded. The Apple Wood will however always give reasonable consideration to specific requests for use of the Accommodation which may relate to occupancy (for example, a function or celebration). If the Visitor wishes to hold any function or celebrations exceeding the occupancy limit it must first obtain the written permission of The Apple Wood. If permission is granted, an additional charge will be made.

8) Services
a) The holiday price will include all reasonable charges for water and electricity. Visitors must comply with the instructions found in the welcome pack in the Accommodation regarding the appropriate fuel for use in the stove within the Accommodation.
b) Any damage caused by using inappropriate fuel will be charged to the Visitor.

9) Liability and Loss of Visitor Property
a) Any Visitor’s property found at the Accommodation or on The Apple Wood property be disposed of if it is not collected within 6 months and The Apple Wood may charge a reasonable administration fee to cover the costs of storage and handling of lost property.
b) The Apple Wood will not be liable for any loss of property or any other loss or damage caused by it or its agents or contractors: unless it has breached a legal duty of care owed to, or contractual term for the benefit of, the claiming party.

10) Pets
a) Pets are not permitted in the cabin or on the property.
b) Assistance dogs are very welcome in the Accommodation, however the Visitor must notify The Apple Wood of the intended presence of any assistance dogs prior to arrival.

11) The Apple Wood Right of Entry
a) As with any Accommodation, there is a need for ongoing and occasionally unforeseen work. The Apple Wood and its contractors may enter the Accommodation at any reasonable time for reasonable cause. This includes the need to undertake inspections and audits necessary to operate the business, the undertaking of unforeseen (internal and external) remedial repairs for which access to the inside of the Accommodation may be required. External windows and doors may be opened during this process.
b) The Apple Wood will give the Visitor reasonable notice of such requirements, and aims to restrict the working hours of our contractors to between the hours of 09.00 — 17:00. If this is not possible The Apple Wood will offer you reasonable compensation for any foreseeable inconvenience or loss of enjoyment caused on that day.

12) Visitor Obligations
a) The Visitor will be responsible for all payments and for any damage whether caused by the Visitor or his or her party. The Visitor agrees to make his or her party aware of these Terms and Conditions.
b) The Visitor agrees to maintain and leave the Accommodation and its contents in the same state of repair and condition, and in a clean and tidy state as at the commencement of the booking period (reasonable wear and tear excepted). This includes:
(1) Not to deface, make any alterations or additions whatsoever to the interior or exterior of the Premises or to the decoration, fixtures or fittings of the Premises or to the furniture.
(2) To keep the furniture, soft furnishings and equipment in their present state of appearance/repair.
(3) Any items of furniture which may be found to be missing or damaged (reasonable wear and tear excepted) will be charged to the visitor.
(4) Not to remove any of the furniture from its present position in the Premises.
(5) Not to affix any poster, notice, sign or placard to the interior or exterior of the Premises.
c) The Visitor agrees not to do anything or suffer or permit anything to be done as a result of which any policy or insurance held by the Owners on the Premises may cause a claim, become void or voidable or subject to an increased rate of premium.
d) The Visitor agrees not to play or permit to be played in the premises any musical instrument or sound production equipment between 11.00pm and 9am or so as to be audible outside the premises.
e) The Visitor must allow The Apple Wood and/or its agents to enter the Accommodation to inspect the state of it, on reasonable notice, except in emergency when immediate access must be granted.
f) The Visitor must not use the Accommodation or allow its use for any dangerous, offensive, noisy, illegal or immoral activities or carry on there any act that may be a nuisance or annoyance to The Apple Wood or to any neighbours.
g) The Apple Wood will not tolerate any verbal or physical abuse towards any of its staff or representatives.
h) The Visitor and his or her party must comply with any reasonable regulations relating to the Accommodation of which the Visitor has written notice. Such regulations will be found in the welcome folder in the Accommodation, typical examples would include any local conditions regarding parking, waste disposal and recycling.
i) Smoking is not permitted in any part of the Accommodation and the Visitor and any member of his or her party agrees not to smoke inside the Accommodation.
j) Smoking outside is discouraged due to the woodland setting. Any damage caused by open flames/cigarettes/cigars will be charged to the visitor.
k) The use of candles or fireworks by the Visitor or his or her party at the Accommodation is strictly forbidden unless expressly agreed in writing, in advance, with The Apple Wood. Use of barbecues is only permitted in the open areas illustrated in the information pack.
l) There is a gravel path outside the log cabin for vehicles to park while packing and unpacking vehicles only. Vehicles are not to be parked on the gravel path outside the cabin for the duration of the visitors stay. All vehicles must be parked in the allocated spot at the front of Apple Wood House.

13) Insurance
a) It is the responsibility of the Guests to ensure that their personal possessions are insured. We cannot accept any liability for theft of, loss of or damage to personal possessions including vehicles and recreational items. We also recommend that guests arrange adequate travel insurance for cover in case of cancellation (see CANCELLATIONS).

14) Liability
a) The owners of The Apple Wood are not liable for any loss or damage to any Visitors property or any property belonging to a member of the Visitors party howsoever caused.
b) The client or members of his/her party cannot hold the owners of The Apple Wood liable for any personal injury/death howsoever sustained where the owners and/or their employees have used reasonable skill and care; and/or where caused by the recklessness of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the actions/omissions of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.

15) Damages and Security Charge
a) The Apple Wood recommends that Visitors hold personal insurance for accidental damage and personal liability.
b) If on arrival at the Accommodation you discover that anything is missing or damaged then this must be reported to The Apple Wood immediately otherwise it will be presumed that the damage/loss was caused by the Visitor and a charge will be made.
c) A refundable damage deposit of £250 must be paid a minimum of 48 hours before arrival. The cost of any damage or breakages up to the value of £250 will be deducted from the deposit and the remainder refunded to you. If no damage or breakages happen during your stay the deposit will be refunded to you in full within 4 weeks of the end of your stay. You will be responsible for the cost of any breakages and/or damage caused in excess of £250, and this will become due immediately.

16) Water Supply
a) We cannot accept responsibility for a shortage of water at the Accommodation where this is as a result of a drought, an act or omission of the relevant water services company or for any other reason outside of The Apple Woods reasonable control.

17) Weather
a) If the Accommodation becomes inaccessible due to bad weather The Apple Wood will take reasonable steps to inform the Visitor. The Apple Wood’s liability does not extend to weather related conditions that affect public roads.

18) Comments/Complaints
a) Every reasonable care will be taken to ensure that the Accommodation is presented to Visitors to a high standard. Should the Visitor find on arrival that there is a problem, or cause for complaint, the Visitor should immediately speak to the owners at Apple Wood House (On the premises). Reasonable steps will then be taken to assist the Visitor.
b) The Apple Wood is committed to ensuring that any problems or complaints the Visitor may have whilst at the Accommodation are resolved effectively and promptly, but as such must be given the opportunity to do so. Any refusal to notify The Apple Wood immediately or refusal of reasonable rectification may affect the Visitor’s right to compensation.
c) Visitors must provide a contact telephone number and suitable time for Apple Wood to communicate with them about problems or complaints. Visitors must allow access to the Accommodation by any staff or contractors of The Apple Wood to resolve problems or complaints.
d) Visitors must formally confirm any unresolved complaint in writing or by email) to The Apple Wood within 28 days of the booking end date. We cannot accept complaints if you have not followed the course of action laid down in this clause.

19) Arrival and Departure Times
a) The Visitor and his or her party must arrive after the arrival time (3:30pm on the first day of the holiday period). If arrival is expected to be after 7:00 pm please notify The Apple Wood. You will be asked your expected arrival time in your post booking confirmation email in order to ensure we can welcome you and properly introduce you to the holiday accommodation without delay.
b) Departure is before the 11.00am on the last day of the holiday period. Any stay that extends over this period will be subject to a charge being made for additional time.
c) The Visitor will be issued with a set of keys to the Accommodation on the first day of the holiday period and the Visitor must return them on the last day of the holiday period or the date of departure, if earlier. Failure to do so will incur the cost of a replacement set and new lock changes.

20) Right to Evict
a) The Apple Wood may terminate the Agreement on notice, and in such case the Visitor and his or her party must leave the Accommodation, (without compensation being payable to the Visitor or any member of his or her party) if: this is deemed necessary by The Apple Wood where there is a serious breach by the Visitor of the Agreement or the Visitor’s or his or her party’s behaviour endangers the safety of other Visitors, wildlife or members of staff; or any complaints are made of anti-social, unacceptable behaviour or unreasonable breakages or damage occurs or smoking restrictions are not observed.
b) As a holiday letting, this Agreement is an excluded Agreement for the purpose of the Protection from Eviction Act 1977.

21) Data Protection
a) The Apple Wood may communicate with you from time to time about special offers. If you wish to alter the way we communicate to you at any time you can email info@theapplewood.co.uk

22) Governing Law
a) The construction, validity and performance of the Agreement shall be governed by the law of England and Wales, and both parties submit to the exclusive jurisdiction of the UK Courts.

23) Longleat tickets

a) Valid on the adult, child, senior Longleat All in One Day Tickets only.

b) It is the guest’s responsibility to ensure that Longleat is open on the date(s) ticket are requested for.

c) To secure tickets online you must book no later than midnight (GMT) on the day before your intended visit. Longleat will be unable to honour tickets purchased on the same day of visit.

d) The Apple Wood’s discounted offer is non—transferable and cannot be used in conjunction with any other offer or promotion.

e) Longleat reserves the right to close to the public, withdraw any attraction, alter times, prices and events or services without notice.

f) Ticket bookings are non-refundable.

g) Ticket dates cannot be changed once booked.

24)  General

a)     This Agreement is made on the basis that the Premises are to be occupied by the Visitor for a Holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Visitor acknowledges that this Agreement is not an assured tenancy and that no periodic tenancy will arise on the determination of the letting period.

b)    The terms and conditions of the Agreement become valid upon written confirmation by The Apple Wood of acceptance of the holiday letting period for the agreed letting period.

c)     On receipt of documents from us you must advise us if anything appears to be incorrect. The Apple Wood regret that we cannot accept liability if we are not notified of any inaccuracies within 10 days of our dispatching the documents to you.
